1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the websites, applications and related services operated by 1000091347 ONTARIO LIMITED, operating as TryIt AI ("we", "us" or "our"), including tryit.ai, NoisePlayer and FindAIChat (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Permitted use

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to misuse the Services, attempt to gain unauthorized access to systems or data, interfere with the operation or security of the Services, or use the Services in any way that violates applicable law.

3. Product availability

Our products may be offered on different platforms, including web and mobile. Features, availability, pricing and supported regions may change over time. Some products, including NoisePlayer, may be in development and not yet publicly available through app stores or other distribution channels.

We do not guarantee that any product will remain available indefinitely or that every feature will be uninterrupted or error-free.

4. User conduct

You agree that you will not:

• Use the Services for unlawful, harmful or fraudulent purposes
• Upload or transmit malware, spam or other malicious content through the Services
• Reverse engineer, scrape or copy the Services except as permitted by law
• Impersonate any person or entity or misrepresent your affiliation with TryIt AI
• Interfere with other users' enjoyment of the Services

5. Intellectual property

The Services, including software, design, text, graphics, logos, trademarks and other content, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the Services as permitted by these Terms, no rights are granted to you.

You may not copy, modify, distribute, sell or create derivative works based on the Services without our prior written permission.

6. Third-party services and links

The Services may contain links to third-party websites, tools or services, including external products and platforms. Those third parties are not controlled by us, and we are not responsible for their content, policies or practices. Your use of third-party services is at your own risk and subject to their terms.

7. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, secure or free of errors or that any defects will be corrected.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF CAD $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, IF ANY.

9. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms, if required by law, or if we discontinue a product or service. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability and governing law.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Subject to applicable law, the courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.

11. Changes to the terms

We may update these Terms from time to time. The "Last updated" date indicates the latest revision. If changes are material, we may provide additional notice where appropriate. Continued use of the Services after updated Terms take effect means you accept the revised Terms, to the extent permitted by law.
